The first step is hiring a good lawyer. This may seem obvious or maybe you think you can handle this on your own. It is and you can't. Without proper child custody strategies you have no real chance of winning. Think of this as a war and you need the best General out there to protect you. A child custody attorney has been through this many times, so he gives you the best chance to be well represented. For referrals, ask around chances are you know someone who's been through this before. If you can't find a personal recommendation, you can always call your local state bar.

Once you're armed with a good attorney, the next most important child custody strategy is to work with him to build a clear picture of why the child is best placed with you. It is not enough to say the other parent is a bad or neglectful parent, you need facts and examples. Testimony from clergy members, teachers, even doctors is ideal. Also, document every incident that supports your child custody case. Don't just say my child is being neglected; describe "neglected." Describe her clothing, hair, nails, etc. describe in detail the signs that lead you to your beliefs and fears. Bring in the tattered clothing, photos, videos etc. these help lend credibility and paint a clear picture in the judge's mind.

Another powerful tool in your child custody strategy arsenal... don't get caught up in name calling or mudslinging; stick to the facts. It's important the judge understands you're not trying to keep the other parent from the child completely. You just feel he would be healthier living with you on a full time basis. Remember, this is all for the best interest of the child. Reminding the court of every lousy thing the other parent has done takes the focus off of what a great parent you are.

This process can be slow and intimidating; however by arming yourself with the best child custody strategies you improve your chances of a positive outcome.

When parents are involved in a custody battle, they are usually focused on protecting their own individual rights. In other words, mothers are concerned about protecting their rights as mothers; fathers get focused on ensuring that they maintain their rights as fathers. However, often lost in the middle of all the motions, briefs, opinions, and petitions, is the fact that, in each and every state, when it comes to custody and visitation, the children have their own set of rights.

The judicial system in each state considers numerous factors in arriving at a final child custody arrangement. And while the opinions and desires of an older child generally carry more influence than those of a younger one, the following list of rights is generally upheld for children of all ages.

The right to a continuing relationship with both parents.
The right to be treated, not as a piece of property, but as a human being having unique feelings, ideas and desires.
The right to continuing care and proper guidance from each parent.
The right to have his views and opinions of one parent not be unduly influenced by the other parent.
The right to express love, friendship, and respect for both parents, and the freedom from having to hide those feelings or emotions.
The right to know the impending divorce was in no way caused by any actions of the child.
The right not to be the subject and/or source of arguments.
The right to continuing, honest information regarding the divorce process.
The right to maintain regular contact with both parents, and the right to a clear explanation for any changes or cancellations of plans.
The right to enjoy a pleasurable relationship with both parents; the right never to be used as a manipulative or bargaining tool.

Parents who can study, understand, support, and enforce these rights on behalf of their children will reap immeasurable rewards in their relationship with their kids. Parents who ignore and repeatedly violate these rights run the risk of damaging their relationship, credibility, and their children themselves beyond repair.

Please parents, do your best to rise above the differences you have with your ex-spouse, and keep the rights of your children in mind when dealing with custody issues.

Even though these parents may feel that they have good reasons for each change, a judge will examine the overall pattern and raise concerns about consistency and dependability.

Think about it... ever notice how your child enjoys watching the same movie or T.V. episode over and over again? Children thrive on repetition and permanence in all aspects of their lives. A judge can be persuaded to overlook many less than ideal choices in your housing, job, or relationship if they are stable over the course of time. If, for some reason, you do need to make a change in a major area such as employment or housing, you need to do so carefully and with a well-thought-out plan.

If you make a number of changes to your life, the other parent will attempt to persuade the judge that, no matter how good your current situation seems, based on your history of instability, it is unlikely to last. You won't be able to convince the court of your good position if the other side can point out that it is likely to be short-term and undergo constant change.

Ideally, you should try to find housing that is at least comparable, if not an improvement on what the children had before the divorce. It doesn't have to be fancy, just similar in terms of living space and amenities.

Of course, your finances may limit your options. However, no matter where you end up, it is of utmost importance to keep it clean and habitable. Judges are extremely influenced by pictures of dirty homes, overflowing trash cans, unclean kitchens, and dingy rooms. Even if you must rent something that is less than perfect, adequate sleeping areas and superior housekeeping will go a long way toward keeping you on equal footing with the other parent.

The problem that unwed fathers have always faced with child custody is that the mother-child relationship has always been treated as sacred and untouchable. In recent years however, the "best interests of the child" has become the yardstick that all decisions are based on. Since this is the yardstick, we need to adjust our thinking to fulfill this mandate.

Let's begin with the premise that the most important interest of the child is the child's relationship with their parents. That being the case, the court wants the child to have access to both parents, in so much as it serves the "best interests of the child".

If parents get along well, communicate easily, and work together to parent the child, then joint legal and physical custody, and near equal visitation are easy to have awarded by the court. Of course if this were the case, you wouldn't be reading this article because you would already have solved your custody issues. But think about the premise that makes sharing equal time possible in this scenario. The premise is that the parents are not in conflict about raising the child. Since they are not in conflict there is no reason to award sole physical custody or most visitations to one parent.

Now let's look at the unwed father who is in conflict with the mother. Why would the court award custody or equal visitation to parents who are living in constant battle and turmoil? They wouldn't because it is NOT in the "best interests of the child".

You on the other hand have a high conflict relationship with the mother, so where does this leave you, out in the cold unless of course you can provide a low conflict environment for the child. But how do you get a woman who is very willing to be high conflict with you, to be low conflict? The answer is, you don't need to.

Here is where the strategy comes in. You can take an approach know as "Parallel Parenting". You need to show the court that you are a parent who is involved in your child's life and that you have minimal contact with the mother. The only contact you should have with mother should be in writing, email if possible. Share grades, doctor's notes and any information you get. Don't respond to any negative emails. Ask the court, if you need to, to create boundaries for both of you that will limit the opportunity for high conflict encounters (contact only by email, no contact on exchanges, etc). Spend time at school, help coach a sports team, host birthday parties. Make sure you are involved.

What you have just created is a drama free zone with rich activities to share time with your child. This is just what the court envisioned. For the court to deny lots of time to a devoted father who has made great efforts to create a great environment from chaos would NOT be in the "best interests of the child".

This will be the hardest job you will ever undertake, but will be the most rewarding.

I have written this article to assist mothers who wish to protect their rightful role as primary caretakers of their children. A mother's child custody battle, most often is a very stressful situation. To make things worse, many women don't play as active a role as they should throughout the court process and tend to overly rely on their attorneys.

This can potentially put a mother's child custody case in jeopardy, due to the fact that the ex spouse as well as the attorneys on both side will take advantage of this.

In this article, I want to provide some guidance to help you get through this as best as possible. There are many things to look out for and keep in mind, you don't want to make any mistakes that can potentially be used against you.

1. Do not show any hostility towards other women : It doesn't matter if it is the one your ex husband had an affair with, the current girlfriend, or new wife. I know this is hard, but do your best at least until your child custody battle is over with. It can be used as ammunition against your case.

2. Don't call the police on your ex : Unless you or your children are in danger of being physically harmed, this will only make things turn out ugly for everyone.

3. If you are unemployed you need to get a job : You need to show to the judge that you are capable of supporting your children financially and not simply counting on living off of child support of spousal maintenance.

There you have it, these are some very common mistakes that many people make during a mother's child custody case.
